Traffic Citations Not Admissible in Court

We were recently asked: Is there a concept of shared negligence in WA? I was seriously injured in a car accident a couple of months ago and it appears that the other guy’s insurance is saying that they owe me less because I was cited for failing to yield to a pedestrian in a cross walk. The other driver was speeding and assumed that I would stop for the pedestrian and essentially blew the stop sign. This seems wrong to me and I’m wondering if anyone had some quick advice on this.

Our answer follows: In Washington evidence of traffic citations--whether contested or not--are not admissible in court and should be given no weight (on a stand alone basis) in settlement negotiations.
