Pedestrian Injury Accident--Establishing Liability

A recent accident in Snohomish County highlights an ongoing problem in the Northwest--particularly a problem during the winter months. Pedestrian v. Motor Vehicle accidents
are a major cause of injury and death. The problem is more pronounced during the winter when there is less light.
A man, 73, was hit by a truck while he was crossing Rucker Avenue in Everett, Washington. He was flown to Harborview Medical Center with serious injuries and remains there in critical condition.
Insurance companies for at-fault drivers vigorously defend these cases. As observed in earlier blogs, they emphasize (or invent) a variety of factors/excuses intended to shift blame from the motorist to the pedestrian. As a result, what appear (facially) to be clear liability cases are often hard-fought. It's critical to contact an attorney even if the driver was cited for an infraction (unfortunately citations--even if contested--cannot be introduced in personal injury cases).
