Should You Keep a Pain Diary? The Answer is No.

Often personal injury clients are asked to keep journals related to their symptoms so that their pain is “documented.” However, keeping such a diary can be somewhat unnatural and causes a particular focus on discomfort that can take away from the recovery and healing process. Furthermore, diaries which include topics unrelated to the personal injury action can be used in cross-examination by defense counsel.

Instead of keeping a pain diary, it makes more sense for clients to testify based on memories of their symptoms and experiences. If the symptoms weren’t bad enough for the client to remember, they probably would not have been a source of significant compensation.
