Cruise Ship Victims Face Strict Provisions When Filing Suit

Cruise ship season kicked off in Seattle yesterday when the first cruise ship of the season entered the Port of Seattle. The cruise ship industry has grown tremendously in recent years. Nine years ago only six cruise ships passed through the Port of Seattle. This season the port is expecting 211 cruise ships, carrying more than 800,000 passengers in total.

Once again, we have a drug manufacturer profiting on the public’s health fears and concerns by claiming to have found a wonder drug, a cure all pill to one of the leading causes of death, heart disease, only to find out that the claims are a farce intended to increase the companies’ bottom line. Over the weekend there was breaking news that the drug Vytorin manufactured by Merck was determined to have no benefit—Vytorin has been proven to be ineffective in treating or reducing the incidence of heart disease.
Bus Accident in Port Orchard: Getting Damages from the Government

On Thursday afternoon a Clallam Transit System bus in Port Orchard started a chain reaction accident. The bus struck a small blue pickup in heavy traffic. The impact occurred at less than 20 mph. The blue pickup was carrying a ladder that cracked the bus’s windshield. The pickup was then pushed into another car that then struck a utility truck that then hit another truck. The driver the blue pickup sustained a minor head injury. One of the passengers on the bus was treated for neck and back pain.
Monkeyshines in Spokane

Last week a pet monkey, named Chico, escaped its owners’ home and bit three people on Spokane’s South Hill. One of the monkey’s victims, Arron Trujillo, was walking his dog when the monkey chased him down the street, growled and bit him on the thumb. Arron’s mother, Dorothy Trujillo, was also bitten when the monkey charged at her and bit her leg. A teenage girl in the same neighborhood was another bite victim.
Bus Accident Highlights Need for Separate Representation

A Metro bus accident Wednesday afternoon at the Kent-Des Moines interchange resulted in 14 people sent to the hospital with injuries. The Route 174 bus was traveling southbound on Pacific Highway South when a Toyota Camry turned in front of the bus, attempting to make a right turn into the parking lot of a Walgreens. One passenger, Sonia Tejada, 20, said she was near the back of the bus and was thrown to the front when the driver hit the brakes. None of the injuries were life threatening. The driver of the Toyota Camry was one of the 14 people sent to hospital with injuries. The accident is currently under investigation.

Recently we were asked: My son was sleeping in the back seat of our car when we were hit by a drunk driver. My son hit his head and still has a lot of swelling. My husband says that we cannot sue the driver because my son was not in his car seat. Is this correct? We were not cited for not having him in his car seat.
Car Crashes Leading Cause of Death in Teens

Getting your driver’s license when you’re sixteen used to be one of the milestones of growing up in America. But laws restricting or modifying the driving privilege for drivers under eighteen are becoming more prevalent. A recent article in the Seattle Post - Intelligencer highlighted some sobering statistics regarding teens and driving. Car crashes are the leading cause of death of persons aged 8 to 17. The three biggest factors contributing to these deaths are: (1) Riding without a seatbelt, (2) driving with a new teen driver and (3) driving on high-speed roads. The most dangerous teen drivers are those under the age of 16 and those driving on roads with a speed limit of over 45 mph.

We recently blogged about a Seattle Post-Intelligencer article that said that the following circumstances are most likely to result in a motor-vehicle fatality : an unrestrained passenger riding in a vehicle with a teen driver on a high speed roadway. We were recently asked: I was rear-ended by a pizza delivery person, or rather “kid.” He was flying and both my daughter and I have bruises from head to toe. Insurance covered the car but they are saying that they will not cover lost wages and rehabilitation for me or a tutor for my daughter who has already missed two weeks of school. While no one broke any bones, this is a real problem. We are really hurt and I think this insurance company is disregarding our pain because nothing is broken. Any ideas?
Traffic Citations Not Admissible in Court

We were recently asked: Is there a concept of shared negligence in WA? I was seriously injured in a car accident a couple of months ago and it appears that the other guy’s insurance is saying that they owe me less because I was cited for failing to yield to a pedestrian in a cross walk. The other driver was speeding and assumed that I would stop for the pedestrian and essentially blew the stop sign. This seems wrong to me and I’m wondering if anyone had some quick advice on this.

It's fun to ride in groups. Whether the groups are honorary in nature (like a funeral procession or tribute ride) or ad hoc, it makes sense to follow basic rules and make sure that everyone has a shared understanding. Otherwise all riders are at risk for motorcycle injuries . These points were reinforced by a recent and very unfortunate accident. A police officer who was riding in Hillary Clinton’s motorcade died recently in a crash in Dallas. This death highlights the danger of participating in motorcycle escorts. These dangers stem from the high speeds (often up to 120 miles per hour) police officers reach while speeding from the back of the pack to the front in order to block off intersections and clear traffic. In a motorcade there is also a higher chance of losing control or getting blindsided by car or having to swerve for pedestrians.

A near tragic collision in Tacoma reminds us of the risks bicyclists face on the streets. At about 5:30 a.m. on Sunday Sandy Johnston, 66, was hit while cycling through the intersection of Ramsdell Street and Contra Costa Avenue in Tacoma, Washington.

A tragic accident in Fircrest reinforces a frequent refrain in this blog: buy the most PIP and UIM insurance you can afford. Bicyclist Sandy Johnston, a 66-year-old University Place resident, was struck by a motorist who stopped and dragged her to the side of the road before leaving the scene of the accident. Johnston had multiple fractures and cuts and was taken to Tacoma General Hospital for treatment.
Accidents on the Way to and Back from the Mountain

Ski and snowboard accidents are a frequent focus of this blog. However, even more frequent than skiing or snowboarding accidents meriting legal attention are car accidents that happen on the way to and from the mountain. On the way to Crystal mountain last weekend I saw a truck on it's side in the middle of the road and another upside down in the ditch. Last night on the way to Whistler I saw a number of "near-misses". It's really unfortunate when accidents happen on the way to or from the Mountain. It's tragic when these accidents result in injuries or deaths. And that's what happened last week near Mt. Baker.

Passengers Injured in Wrong-Way Crash on I-5 in Arlington

A man driving south in the Northbound lanes of I-5 was killed when he collided head-on with another vehicle at freeway speed. The wrong-way driver, Jason French, 33, died at the scene of the accident. Two Sedro-Woolley women were in the car French collided with. Both women suffered serious injuries and were taken to a local hospital. The accident is under investigation.
Driver Charged in Death of Bicyclist in South Kitsap

Delores Magneson, 59, has been charged with the death of bicyclist Craig Hatt, 41. Magnesson allegedly hit Hatt last September on Mile Hill Drive in South Kitsap. After the accident Magneson claimed that her windshield had fogged up, as a result of just behind washed and glare from the sun, obscuring her vision.

Sometimes people who cause accidents walk away unscathed. But other times they don’t. This happened on Tuesday on State Route 507. On Tuesday night a man from Roy, Washington, was killed in a car accident on State Route 507 near Spanaway. At about 9:30 p.m. the driver, 39, was driving southbound on State Route 507 when he lost control of his vehicle, veered off the right side of the road and into a power pole. His passenger, 35, was transported to Good Samaritan Hospital with injuries. The cause of the accident is under investigation.

Pet Injured in Head on Crash

Many people drive with pets in their cars. And, maybe more often than we think, pets are being injured in motor vehicle accidents. A poodle riding in a pickup truck was seriously injured when a driver traveling the opposite direction on State Route 515 crossed the center line and hit the pickup head on. The pickup driver, a 48-year old woman from Kent, and her passenger, a 49-year old man from Kent, were transported to a hospital with neck and back injuries. The poodle was taken to a local veterinary hospital for surgery.
Products from China Continue to Harm American Consumers

Retailers selling products from China have been beleaguered by claims arising from defects in the Chinese-made products. One of the most publicized cases involved dog and cat food. Our firm filed the first nationwide class action lawsuit in that case against Menu Foods and the other companies that sold the tainted pet food. Now another Chinese-made product is harming American consumers, the seemingly innocent flip-flop. Since September 2007 Wal-Mart has reportedly sold over a million Sand ‘N Sun flip-flops, a cheap ($2.99) sandal made in China. The flip-flops have caused first and second degree chemical burns on dozens of customer’s feet, directly underneath the straps of the flip-flop.

A recent front page article in the Seattle PI has brought attention to a problem many cyclists have been battling for years: unsafe street drains. Drains covered with grates that have slots parallel to the roadway are dangerous to cyclists as bicycle wheels can get caught - and stuck - in the slots.
Don't Delete Your Email--Deleted Emails Must be Produced

In the recent federal court case, Benton v. Dlorah, Inc., 2007 U.S. Dist. D. Kan, Oct. 30, 2007, the plaintiff testified that she had deleted emails related to the case. The court ruled that deleting emails did not necessarily remove them from the plaintiff's possession. It reasoned that deleted emails should be retrievable from her computer system and thus remain within in her control.

Tacoma man killed by drunk driver

On Christmas Eve Peter Pung, 18, was killed by a drunk driver. Pung was driving on Golden Given Road East in Tacoma, Washington, when a pickup ran a stop sign and T-boned Pung's Honda. The driver of the pickup, Aaaron Wayne Bell, 26, crashed into Pung's car at such a high speed it drove the Honda's passenger-side door into Pung and crushed him against the driver's side door. According to police, Bell was so intoxicated at the time of the crash that he was hardly capable of speech. The magnitude and apparent randomness of this tragic accident is hard to wrap the mind around. It reminds us how vulnerable we really are on the roads--not to mention the terrible toll drinking and driving can take this time of year.
Texting While Driving Banned

Texting while driving officially becomes illegal on January 1, 2008. The law is a secondary violation, meaning that a police officer must first spot another violation (such as a person not wearing a seatbelt or speeding) before someone who is texting can be pulled over. This law and the law banning cell phone use while driving (enforced starting July 1, 2008) are attempts to decrease the number and the severity of collisions. A study by the National Highway Traffic Safety Administration and the Virginia Tech Transportation Institute found that 80 percent of collisions involved distracted drivers.
Fatal Sumner Crash

On Christmas Eve a 35-year old man was killed and two men were critically injured in a car crash on West Valley Highway in Sumner, Washington. According to the police, the driver was speeding, lost control of his vechicle, crossed into oncoming traffic and then hit a tree on the shoulder. The driver was declared dead at the scene of the accident; the two passengers were transported to Harborview Medical Center. Alcohol was found in the vehicle but it is not yet known whether the driver was intoxicated.
Winter Weather Factor in Crashes?

Around this time of year the number of car accidents increases. Some of the crashes are a result of alcohol and some of the crashes are a result of the treacherous winter weather. This Christmas Eve, in many areas the slushy, wet roads turned to ice when the temperature dropped to below freezing in the evening. In Kitsap County emergency dispatchers were flooded with calls. On Christmas Eve they fielded reports of about 68 traffic wrecks between the hours of 8 p.m. and midnight. A number of these accidents resulted in driver and passenger injuries.
Model Ship Builders Reportedly Fleeced in Internet Commerce Scam

Dennis Ray Lunde, 60, of Poulsbo, Washington, has been charged with first-degree theft for running an Internet commerce scam. Lunde posed online as a Navy captain and sold model ship kits. Buyers of these kits would send money to Lunde but never received the kits.  Several buyers received an e-mail from Lunde’s “wife,” claiming that Lunde was in the hospital and unable to send out the kits.  According to police, Lunde has admitted to sending those emails himself. Since the start of the scam in 2004 Lunde has reportedly scammed 13 people out of a total of a total of $6,100.
Longview Boy Dies in Playground Accident

A 3-year old boy died last Saturday after two adults fell on him at the Hoppin' Houses indoor playground in Castle Rock, Washington. The boy, named Jacob, was at a birthday party and was playing in the area with inflatable slides and obstacle courses. The details of the accident remain unclear but it is known that two bouncing adults landed on top of the boy and they all fell to the concrete floor. Jacob died of head injuries. There's a lot we don't know about what happened--how the playground was set up, what if any rules were followed, the kind of activities that were going on, etc. But one thing's for sure: an accident like this deserves to be investigated and Jacob's family should consider whether they want to bring a legal claim.

On the evening of November 27th, a Seattle woman in her 50's was hit while walking across a crosswalk at the intersection of Aurora Avenue North and North 90th Street. The woman was hit by a pickup and dragged underneath it. The driver of the pickup left the scene but was stopped several blocks away by police. The woman who was struck suffered head and pelvis injuries and was transported to Harborview Medical Center in serious condition.
Jogger Struck, Killed by Driver

A jogger was hit and killed by a motorist Saturday while jogging down Duvall Avenue Northeast in Renton, Washington. The 37-year old jogger was traveling along the northbound lanes when a southbound car drifted across four lanes of traffic and hit the jogger from behind. The car then went down an embankment. The 34-year old driver sustained injuries.
Multivehicle Accidents--Complexity and Opportunity Collide

On December 11th three people were taken to Harborview Medical Center after a mulitvehicle accident on Highway 522 near Monroe. A man driving westbound reportedly lost control while driving around a curve, his car then struck a guardrail and skidded into the eastbound lane. The out-of-control vehicle collided with an eastbound truck. A third vehicle, driving behind the eastbound truck, stuck the wreckage.
Workers Hurt on the Job Not Limited to Workers' Compensation Benefits

During the morning commute last Friday an SUV slammed into a Department of Transportation worker's truck on Interstate 5 in Fife. The collision killed the SUV driver, Roy P. Fuentes, and injured the 56-year-old State worker, David Ball. Ball was outside of his vehicle at the time of the collision, clearing debris from the far-left lane of southbound I-5. The DOT truck was pushed forward and hit Ball. Police believe inattentive driving, speed and possibly drugs were factors that contributed to the crash.

This summer our firm tried a case against the Wizard, one of the vessels shown on Disney’s “Deadliest Catch” television series. The case arose from a career ending shoulder injury suffered by a crew member when he slipped and fell down the engine room stairs. We prevailed in court and established that the Wizard was negligent and responsible for the fisherman's damages. During the case we relied extensively on material from the “Deadliest Catch” and the Wizard's own website. In preparation for the case we watched every episode of the “Deadliest Catch.”
Sean Heldt's Death Still Considered a

Sean Heldt had been in a coma for almost six months at Harborview Medical Center before he passed away on Wednesday, November 7th, a few weeks shy of his 25th birthday. Heldt died following a May 25, 2007 accident on Interstate-90 when the car he was driving was hit head-on by a man with a blood alcohol content more than three times the legal limit. The intoxicated driver and his 2-year old son were killed instantly. Hedt's girlfriend, Christina Grimsley, 26, was also killed instantly. The only survivor of the crash was Grimsley's infant daughter, who was in a car seat during the crash.

A 15-year old student was hit Friday morning by a pickup truck while crossing the street on a marked crosswalk. The driver of the pickup truck who hit the student fled the scene of the accident; police continue to search for the driver. The Stadium High School girl was transported to the hospital with a broken leg.
Metro driver fired, accused of neglient driving

The Metro bus driver, Sandie Olosky, 35, who was involved in the head-on collision in April that killed a man, will be fired by Metro. The accident occurred on Highway 164 when Olosky failed to slow with traffic and swerved into oncoming traffic to avoid hitting the car in front of her. The bus hit the bumper of the vehicle in front of her and then collided head-on with a truck driven by Michael Dahlquist, 21. Dahlquist died at the scene of the accident.

Early Sunday morning a driver, suspected to be intoxicated and possibly under the influence of drugs, caused an accident on Interstate 5 in Seattle that injured three people. The driver, driving a 1992 Honda Prelude, hit the guardrail, spun out and then returned to the northbound lanes where another car hit his car at a right angle. The three injured persons were transported to Harboview Medical Center. None of the injuries were life-threatening.

Sue Hillstrom, the mother of Eric Hillstrom, the young man who was seriously injured in a drunk-driving collision, caused by an intoxicated driver speeding down Interstate 5 in the wrong direction, said Friday, " [The accident] was 100 percent preventable." Cerrissa Christensen, the woman who caused the crash that left a woman (Hillstrom's girlfriend) dead and Hillstrom with serious injures, should never have been allowed on the road in the first place said Hillstrom's mother.
Construction Worker Injured when Boom Truck Tips Over, Potential

On Tuesday a construction worker at Microsoft, located in Redmond, Washington, was injured when a boom truck fell over. The Department of Labor & Industries, an agency designed to protect workers, will do an investigation as to the cause of the accident. The investigation will focus on the cause of the accident and what the general contractor could have done to make the construction site safer for not only its employees but also the employees of the various subcontractors working there.
Lynnwood Truck Accident Kills One, Injures Two

One young man died and two more were injured in a truck accident near Lynnwood early Sunday morning. Andrew R. Stahley, 22, died. Joshua Kevin Parker, 20, was treated at a nearby hospital and released. Johnny Lee Miler, 27, was transported to Harborview Medical Center. According to the State Patrol, the truck left the roadway, hit the guardrail and flipped over. Two of the men, including Stahley, were not wearing seatbelts.

Drivers in Washington only have to carry $25,000 in liability coverage. That just isn't enough and this inadequate coverage is one of the biggest challenges with our private insurance system. $2.5 million Settlement for Rape of Mentally Ill Woman

Last week a $2.5 million settlement was reached in the 2004 rape incident of a mentally ill woman. At the time of the rape, the woman was a patient at Eastern State Hospital. $1.5 million of that settlement will go towards the victim's future care, an amount declared "reasonable" by Jerry Cartwright, the assistant attorney general who represented the state, considering the amount of care the woman requires. The remaining $1 million will be split between her two attorneys.
Motorcycle Collides with SUV

On Saturday evening, a 20-year old man riding a motorcycle was injured when he collided with a Sports Utility Vehicle. Witnesses to the motorcycle collision said that the injured man and another motorcyclist had been speeding and passing cars in an aggressive manner directly before the man collided with a sport utility vehicle at about 7 p.m. The two people in the vehicle were uninjured.

The driver of an all-terrain vehicle lost control and struck two teenagers on skateboarders. The driver of the ATV suffered a severe head injury and the two boys that were hit suffered potentially serious injuries, according to police.
Car Strikes, Injures 2 Girls on Bikes

Friday evening, around 5 p.m. two 13-year old girls were struck by a car while riding bikes on the shoulder of a road. The woman driving the vehicle that struck the two girls was reportedly distracted by the dog that was riding with her. The woman veered into the shoulder, struck the two girls and then hit a power-pole in a ditch alongside the road. The two victims suffered serious injuries from the collision and were airlifted to Harborview Medical Center.

The cameras were part of a $460,000 pilot program that intended to decrease collisions, drivers running red lights and drivers failing to stop before turning right on red. A preliminary report that tracked the camera's statistics through the end of May 2007 was recently released. The report found that the cameras have failed to produce any reduction in the number or frequency of car accidents. However, the severity of the accidents and the amount of resulting injuries appears to have decreased since the cameras installation.
